Hello,
I am about to complete my sixth year on my H1 and find my chances of surviving a re-org in the company at best 50-50. If I still have my job after the re-org, this would not be an issue, as I would expect to have enough time on my job for the pending federal LC clearance and I-140 clearance following that. However if I lose my job, I guess I would be forced to stay outside the US for a year prior to returning on a fresh H1.
What if as a Canadian citizen I find a company to sponsor me for a TN visa? Would I be allowed to work in the US again immediately following my H1 expiry? Or would I not be allowed to return to work in the US for a year?
My wife an Indian citizen is on a H1 and has many years to go on it. We plan to initiate LC/GC process for her shortly as she would remain in the US and not necessarily follow me back to Canada.
