My 6th year is expiring on Sept.20,
2006. I understand I can apply for my extension
probably in about a week (technically 6 months before,
but with the lag in processing time at the California
Center, I guess by the time they take up my case, it
would be 6 months prior to Sept.20, 2006…so I want to
apply a little earlier).

My company’s attorney is quite dumb and has been guiding my company wrongly. I have a few questions and would appreciate your
response please:

1. Can I apply thru’ premium processing for the
7th extension? I am NOT doing an H1 transfer…just
applying for the extension since I am with the same company and my H1B transfer was already approved in the second week of Feb.2006. I believe the fee for the extension is $500 (is this correct).

2. When I applied for an H1 transfer to my current company in
Oct/.2005, the California Center sent a huge RFE
including one asking for the client contract info. I
managed to get a contract on paper till December 2007.
Will this be sufficient for them to give me my
extension till at least September 2007? Or is any
thing in addition to this contract + LC pending over
365 days needed to get my visa till September 2007.
Please advise….I just want to make sure my attorney
does not make a mistake again. Thanks!!

Yes you can do premium processing, $1000 per case.

I think it should be fine since you will get yearly extension, but you can never be sure.

Ans: I think you can apply for just regular extension. Since you have time and also you are with the same company. If it' second extension from your company your fees will be ($750 + $190) if your company has less than 25 employees. If > 25 then it'll be ($1500 + $190).
