Hi,

I am going to finish my 6th year of H1 by Nov, 2004. I am out of USA for 3 months and can extend it to Jan, 2005.

What are the chances of getting H1 extension for those 3 months???

I have come across one new employer who is willing to give me pre-approved labor and can file for I-140/I-485. The new employer also said he can get 7th year of H1 extension for me.

How can the new employer get 7th year of H1 extension???

Please suggest me what is the best option for me...

Thanks in advance,
Raghu.

maintain I 140 Pending.

Raghu,

I see what u r employer is saying.

He will give u the pre-approved labor and he will file for I 140 and I 485 at the same time.Once u r 1 140 is pending then he can extend u r H1B for 7th year.Thats sounds good.

But one thing for sure,u have to File I 140 and I 485 before u r H1B Expires.

Good Luck

Any thoughts on this scenario:

6th Yr H1 ending in Nov 2004. 7th Year H1 extension filed till Nov 2005. Concurrently filed I-140 and I-485 still pending. Crossed 180 days on this concurrent filing. AP and EAD approved. FP is done too.

Can this 7th year extension be transferred to a new employer?? If something goes wrong with the job and 140 is still not approved by then, what happens?? What are the options??

Any thoughts are appreciated.
