h1 6th year is reaching, but petition is valid more than 6 years

Hi All

My 6 years h1b will be over in Jan 2007. I haven't not filed labour, but I am going to file in this month in PERM.
I have used abt amost 5 months of vacation in last 6 years. Two times 2 months each and other time 1 month.
Can i recapture my vacation period.
Technically on Jan 30th I will complete my 6th year. But my h1 petition and visa is valid till august 2007. My lawyer made a mistake when he submitted my petition, so I got few extra months. But I guess I am not supposed to stay more than 6 years even though I have granted more than 6 years.
What should I do now, Do I need to submit another application to recapture my vacation.
What if I donot receive response from USCIS before my actaul 6th year is over

You shouldn't use the extra time.. that would basically mean you will have lived beyond 6 yrs and out of status.
If you still have not applied for PERM.. You don't have any option but to get the H1B approved for extra 6 months.. but chances are maybe your lawyer did that while applying last time .. and time you see on H1B is actually valid and you got nothing to worry abt.. check the paperwork correctly..

I have used this 6 months vacation after h1 was approved. My h1 was approved in ealry 2005 and I was on 4 months vacation in 2006..
How do I proceed
