H1 6 Years Expiring - Eligibility for Extension

Hi,

Here is my situation

H1 6 years expiring - Sept 2005

Labor applied - Nov 2003

Labor approved - April 2005

I am going to apply for 140 in the next couple of weeks and the chances that my 140 will be approved before Sept 2005 is very minimal(I cannot use AC21).

My question is can I apply for 7th year extension under Section 106 even though my labor has been approved?

Also, is it better to get 7th year extension and then apply for 140 as I cannot apply for 485 anyhow.

Yes, you can apply for 7th year extension. The fact that you stated your LC process 365 days prior will get you 7th year extension regardless of LC is approved or pending. You have to apply for I-140 to show that you are persuing your GC process.

Can you tell me from which state or fedaral region your LC is approved.

6th year expiring?????????

My LC is pending (more than 365 days now)and my H1b is expring in Jan. 2006. When is the best time to file for my 7th year extension. Any insight or advice. Thanks
 
You can file 6 months in advance from the date of your H-1 expiry.
