My husband filed for labor on march 25th of 2003 according to i-94 form, his h1 visa will expire on april1st 2004,now at the time to apply for 7th year extension ,the lawyer saw that there is an error in i-94 form ,it actually expired on march 3rd of 2004 but she saw on march 19th,so she applied for the 10 months that he stayed in india during his 6 year term instead of applying for the 7th year extension.We are in a great tension whether we will get the visa or not for the months that he stayed in india if not,the lawyer said that we have to go back to india.
If anyone faced this type of situation please help.
