My current H1-B visa (which is stamped on passport) and I-94 expires on 03/2006
I have my approved I-797 valid from 03/2006 to 03/2007. This is NOT stamped in the passport right now.
I am planning to go to Vancouver Canada to stamp the new visa in 04/2006.
When I travel (04/2006), my visa and I-94 in the passport will be expired.
In some cases I have heard that US embassy in Canada may TCNs to go to home country(India in my case) for stamping. That means I will have to go to India to do the stamping.
If unfortunately that happens to me, will I be to permitted to get back to US and travel to India from here? Will I be permitted to re-enter to US from Canada with the expired visa in the passport, but with a valid I-797 (not stamped at that point)?
Please advise.
