I need help/answer regarding the scenario described below:
A first petition for H-1B visa was applied for in Jan 2003. The approval came in the 4th week of April 2003. (As it was a normal and not a premium process application). The person started the job on May 1, 2003. Meanwhile the candidate even before starting the job was in negotiation with a potentially better second offer. After working for 15 days, at the first job location, the candidate went on leave of absence due to personal reasons. By end of first week of June, the candidate finalised the second better offer that was already being negotiated. Then H-1B transfer was filed for in a regular process. (Not premium as it was a transfer).
The candidate gets query from the INS asking for all the paystubs from the time he joined the first employer to the time he joined the second employment. Candidate is in a position to send the stub that he earned for amt. of time he was working at the first job. Basically there is a 20 day gap between the 2 jobs where the candidate was on leave for personal reasons (And as no leave was accrued), no money was paid. The candidate did not resign from the job till he joined at the second location.
How can the above issue be resolved? What reply should the candidate be looking for to answer this query.
