Hi all..

Does the H-1B transfer application process from a University to a
Corporate employer differ in any other way except that it has to count against the CAP limit?

Are there any other special forms to be filled out? (or) Any special
options need to be checked in the transfer application?

Does USCIS consider an application in if it is recieved before FEB 14th?

Thanks,
Nic

Meow,

Thats not true. Infact a H-1B transfer from a non profit organization to a corporate employment requires that it qualifies under CAP.

I want to add one more question to my original post

My H-1B with the Univ starts on Mar20th. Can I still apply for a transfer on a H-1B that has not yet started?

Thanks,
Nic.

H1B transfer from exempt employer to a non-exempt employer is subject to the cap.

You can file H1B transfer up to six months prior to the start of employment for the second employer. You can also start working for the second employer right after filing the second H1B! No need to wait for the approval!

Usually no special forms need to be filled out to the best of my knowledge. Find out if the employer is 'H1B dependent', that is, if the majority of the employees are H1B workers.

Raj,

Thanks for your suggestion. Most of the employees are H-1 holders. I would say 90%. So he is H-1B dependent. Does the firm need to state special forms if he is H-1B dependent?

Given that 43.5K visas were issued until Dec 31st should I ask for a premium processing (or) general processing for my transfer?

Thanks,
Nic.
