Greetings everyone, hope you can help me with this (hopefully easy) questions.
I am currently living/working in the United States with an H-1B VISA that is good till December 2010 as well as my I-94 (and the company is in the process of filling a petition for my permanent residence).
Due to personal reasons, I am planing to go back home for good and leave the United States in about a month or two. I have not submitted a resignation letter to my employer but I am planning on doing so soon.
After resigning my job, I am planning and hoping to be able to remain in the States for a month or two to sell all my stuff, ship the stuff I am planning to take back home, and do some sight seeing.
--- Here are my assumptions and questions ---
Assumptions for question 1: None.
Question 1: Once I resign, how many days after my last employed day can I remain legally in the United States?
Assumptions for question 2: Assume I have no grace period or that I can only stay a few days after resigning my job on an H-1 Visa. Assume I also have a B-2 (tourist) Visa which is good till April 2011. Assume I live close to the border and driving to the border and crossing the border is not an issue.
Question 2: Could I go to the border on the last day of my employment and return my I-94 departure record for my H-1B Visa, cross the border, and then cross back with my B-2 Visa and get an new I-94 with my B-2 Visa? Is this allowed?
