H 1B extension----HELP

Hi,

My H 1 expires on July 25th 2004, when do i need to apply for the extension and how long does it take.

What r the details i need to send for the extension?

Also my wife is on H4 do i need to file an extension separately for her???????

I do not think there is any published guideline about how long before expiry you can file H1b extension, but till 6 months is usually accepted for all kind of forms. File your extension before your H1b expires - VSC is under zero tolerance policy you should not be out of status for even one day.

For your wife you should file I-539. For processing dates check H1b threads. It is usually taking 4-6 months unless asked for premium processing. Go for a premium processing - else you will not be able to leave USA for couple of months.

Don't panic. You should file your H1b extension before july 25. Once you have your H1B EAC number you should be all set.

For 240 days. You must have approval by then to continue on H1b visa to be in status.
