Hello!

I am a H-1B visa holder and I have 4 months remaining on 6 year limit. My I-140 is being processed currently. Am I eligible to extend my H-1B visa for another year?

If the I-140 processing takes more than a year, can I extend my H-1B visa for a second year too?

Thanks.

Yes you are. I remember reading in a posting that one person got a 3 year extension first time he went for extension. And you should be able to extend your H1 as long as your Green Card is being processed.

Hello vr1342...

You need to be more specific.

Is it substitute LC?
IF yes, then your I140 has to be pending for more than a year for 7th year extension. You can apply for 485 concurrently and get EAD within three months to avoid 7th year extension. This would be financially cheaper.

If regular LC,
Then I guess your LC is applied before a year, and you are eligible for 7th year extension.
