I know someone who has an R-1 visa valid until 2010. He works as a junior pastor or something in the church that got him the R-1 visa. He has a degree from a religious seminary. Can this person be sponsored for an H-1B by the church? His degree is equal to a bachelor's I believe.

Thanks!

Yes. No problem but the prevailing wage will be an issue. While the R category is not associated with any wage requirements, the H1 and eventually the labor certification will be tied to what is called the "prevailing wage requirements".

I wouild stick with the R1 category and then apply for the I-360 which, if approved, results in a nice little green card. Best of all - no financial stipulations invovled. Please send me a private message and I'd be happy to give you fruther pointers....

Good luck! :)
