I am on a H-1B visa working for a University. I have graduate degree from US institution. I am applying for jobs in the industry, and have got some good responses, but they want me to join ASAP. I think there is no possibility for me to transfer my H-1B from the University to the industry during this time. Am I right? What are my options? My employer is willing to file for O-1 visa, and they are talking with their attorney. Just to give you some information about me, I finished my Ph.D from a US institute, working as a visiting research associate at academic institute, have about 15 research publications, my research has been quoted in about 7 research papers, I have reviewed 6-7 research papers, and I have been awarded several awards at the university level and one award at national level. I have been also included in Who's Who in America, and Who’s Who Among Executives and Professionals. I already have recommendation letters from several scientists indicating that my research is outstanding and in US national interest. I gathered these letters as I am getting ready to file for NIW petition. Do you think these credentials are good to get me an O-1 visa?
Also, should I file my NIW petition if I am offered this position (in industry). I read somewhere that I need to maintain my H-1B status while my NIW petition is pending. So, if I file for my NIW petition, and then I accept this position and my visa is changed to O-1, how will it affect my NIW petition.
Now a hypothetical question, let's say, I get O-1 visa and join this company. Can I file for EB-1/EB-2 category on O-1 visa and is it easier to get GC under EB-1/EB-2 category when one is on O-1 visa as the requirements are almost the same.
I need advice on these issues. You can see that it is a very fluid situation, please do let me know.
