H-1 Visa transfer: urgent advise needed

I am currently on H-1b visa and the, i was working with a cleint company. my Project with the cleint company got over on Jan 5th 2002. My employer has notified the INS about the termination of my H-1 but he is also not paying me any money while i am on bench. In the meantime i got permanent job offer on 23th jan 2002. THe corporate lawyers tell em that i am out of status as i don\'t haev pay stubs after jan 5th and the INS may deny transfer of visa. Can anybody guide me in this matter
