I have some questions regarding my H-1B transfer.
I was working for Company A from April 2004. My H-1B was with this company. In due course of time I booked my tickets to India MUMBAI and took an interim appointment date of Jan 6th 2005. I understand that I have to send all my papers by Dec 6th 2004.
Meanwhile I got an offer from another company (FM). They applied for my H-1B transfer on Oct 18th. My I-797 will not arrive until Dec 18th under the given scenario where it is taking about 7 weeks for a decision (Vermont processing center). Is it OK if I send my application with information of my current employer (FM), and send my old I-797 with the previous employer, application receipt, letter from FM stating the statistics for approval rate for Freddie, employment letter with Freddie etc(this is what the legal folks in my company suggest. they are not ready to do premium due to some company polciy). I will get my original I-797 when I go for my actual interview.
Will this work. Please let me know what my other options are.
