H-1 stamping in Toronto

Hi,

As many of you are aware, I will be landing in Canada pretty soon and need to get my H-1 stamped on my passport. I already have H-1 approved till 2006, but don't have a stamp.

Is it like applying for a brand new H-1 at the consulate, what is the procedure?

My I-485 is in process here, will this cause any issues at time of stamping...

any advice would be appreciated.

never had H-1 stamp, converted from F-1. This is my second H-1, just got extension approved this January.
 
I don't forsee any problems in you getting a H-1B stamp, provided you have all of the required documents.

I-797 approval notice
I-129 petition copies
LCA copy/s
pay stubs
Letter from your company clearly indication your dates of employemnt, jobtitle, job description, and salary
W2's and Tax returns (not required but take it with you)
Bank Statements
If you are married, your marriage certificate
If you have a I-485 pending did you apply and get your EAD and AP? (the reason I am asking this is in case if the H-1B is denied, you can comeback on AP)
Were you subject to special registration?
Be prepared to stay for 30days or more if the consular officer informs that they have to do a security check.

Thanks for your reply with all the detailed information. Yes, I am an NSEERS registrant. That was completed and went fairly straight forward.

I am not married, have applied for EAD, but still in process. I plan on staying on H-1 with my current employer though.

Some people are advising me to apply for AP, and my attorney is saying to get H-1 stamped. So, I am not sure what to do or what route to take...

But if I apply for AP, I need to do it now since it is taking upto 180 days now..

Any thoughts....

There is nothing wrong in applying for AP. If you apply for AP, it dosen't invalidate your H-1B. If you decide to apply for AP make sure to enclose a copy of your I-485 receipt notice, and also your I-94 which has your FIN#. Otherwise you will get an RFE on your AP. It's not that expensive to file for AP. You can do it on your own. 180days for AP? Are you filing at TSC?

Also when you fill out the DS-156 (non-immigrant visa application, make sure to say "yes" to the question (has any one filed an immigrant petition)

thanks for replying. I think I will apply for AP, yes I am in TX so have to deal with TSC...:(

As you said, no harm in applying for AP...I will get it mailed out next week.
