Hi Guru's

I need help for my friend who got H-1 approval and is about to take an appointment for new H-1 stamping at Mumbai consulate.
Background--He has already been to US twice on 2 assignments of 1-year each , but both times he was on L-1. This is the first time he is going to get H-1 stamped on his passport.

Situation--The new employer in California has applied H-1 showing salary of 48k which are prevaliling wages for 'Programmer analyst' in CA.

What the Problem is---->We have heard from different people/experiences that in Mumbai Consulate they want a min. salary of 60k plus if you are going to CA. In this case we already got H-1 approval from INS which says salary is going to be 48k (which is ofcourse cannot be changed now).
Employer does not have any problem in issuing an offer letter of 60k.(or more than that)

What is the question-->1)Anybody know of any experiences where the H-1 got rejected becuase salary on H-1 approval and offer letter was below 60k.???

2)What if employer gives a new offer letter(for backup) which says salary is 48k but eventually in 3-4 months its going to be 60k plus depending and performance and all that??
Any suggestions on this front greatly appreciated..

Thanks in advance for anybody who can HELP................ :) :)

I don't think the consulate should have an issue - after all the LCA has been approved and the petition is approved.
In any case, You say this:

So why can't your friend take an offer letter (with substantiating pay stubs) of 60k+ or whatever ???

Am not sure I understand your situation correctly.
