H-1 Stamping at Chenna1

Hi guys
I need some advice here. I changed employers recently and have a new H-1 but my old H-1 is still valid until November 2004. My wedding is scheduled for June 25th and I plan to go to India. Do I have to get a new H-1 stamped there or can I still travel on my old H-1 ?

Also, I've been on the 'bench' for nearly 6 mths last year. Will that cause a problem in any way.

Your H1 visa is good for travel until it's expiration. Does not matter if you changed employers.

If you have been on bench (without pay) then it may have serious consequences on your status, specially when your wife tries to apply for a h4 visa at a US consulate. Of late the consulates are not granting visas (H1 or H4) if the H1 holder was on bench without pay.

thanks for the fast reply. Based on what you said, can i just travel and re-enter on my old H-1 and just choose NOT to get my new h-1 stamped? My wife wont have a problem because she is a green card holder. We have'nt applied for my green card as yet but will be after the marriage. Given the conditions and risks, is it advisable to do so.

In that case you can simply re-enter with your existing (still valid) h1 visa stamp and the original H1 approval notice for your current employer. You may also carry a copy of your current pay stub and a letter of employment.
You don't need to get a new H1 visa stamped just because you changed employers.
