Hi there ! I am a recent grad student currently on my opt status. my opt will expire on aug 30 2004.my company has started working on my h-1 visa. with the cap issue going on wat would be my situation.fyi my application would fall for 2005 quota pls respond .thanks alot

For that matter, anybody pending for any change-of-status is allowed to stay. Yes, just not allowed to work.

In my personal opinion, might want to file for H1b, take one-month vacation, if the situation allows, and back to job in Oct. 1, 2004 with approval.
