I am in a fix..I had applied for H 1 B under 65,000 with Oct 1 2005 as a start date which got approved however since my student status expired in March I wasnt issued the I-94 document. (No change of status has been done) I was told to get the stamping from my home country.
Now since I had the Masters degree from the US I have requestd for an "upgrade". If the upgrade gets approved what should be the best course of action?
Is there anything to be worried abt going back to home country and getting the stamp?
How does the consulate look at these cases? Though I ahve applied for an upgrade but since I am out of status since March am I accruing illegal status?
Are there any such instances..Please help!!
