Hi Gurus,

My company is processing my I-140 in Vermont and I got my 7th Year extension for my H-1. My visa stamping in passport is expiring in Feb 08th 2004. I am planning to invite my parents over here sometime this year. My H-1 has been extended through
Feb 05 2005 with I-94 that came with it.

Do I need to have my Visa revalidated at St Louis before I can invite them over here? As such the present visa stamp on my passport expires on Feb 05 2004. The new H-1 extension has an I-94 on it. Will it be acceptable at Chennai Consulate if I send my passport Visa copy and new H-1 papers? For clarification I have been with the same company for last 3 years.

If I send in for revalidation then when I fill up my form DS-156 what should I say for the question “Has anyone ever filed an immigrant visa petition on your behalf"? My dilemma is since my I-140 is not approved should I say yes or no to this question.

Thanks a lot for any insight in this matter.

If you have valid I-94, that should be enough for your parents to get visa.

I was in the same boat...H1 Visa stamp expired, but has a valid I-94. Parents got visa without any problem.

Regarding for the question "Has immigration visa filed on behalf........?"...I wrote "yes". My I-140 has not been approved yet.
