This is a very Interesting case which is very straight forward H-1B Transfer Case with perfect legal Status all along which took many twists and turns due to inefficient Bureaucracy of the INS.
H-1B Case filed in VSC on Sept 09th 2001 ,
File transferred from VSC to NSC (Out of Jurisdiction ) on Nov 20th 2001.
Actual File Mailed from VSC to NSC on Jan 23rd 02 . NSC received the file on Jan 25th 2002.
Received RFE from NSC on March 11th 2002 for Proof of Current Employment Status , Pay Stubs and Replied to the RFE by Fax on March 12th 2002 with all the Documents.
Haven't heard any response from NSC and the Attorney called INS for checking the Status and spoke to a IIO on April 5th , the IIO replied that the Case is in a different location (My Attorney's Interpretation was storage) and a decision was not made on the case by the officer and could have been a Data Entry Error.
IIO said she will get the file from a different location and will get back in 1-2 weeks and took the contact information of the Attorney but never called back and has been 4 weeks .
The Attorney called INS NSC on May 2nd and spoke to a IIO and the IIO says that since you have already spoke to a different officer a few weeks back you should wait till she receives the file or get backs to you.
Attorney mailed a copy of the RFE with the Required Documents my mail.
AVM didnot get updated in NSC except that say the Petition was received on XX Date
The Attorney called NSC on atleast 7 different occasions and got the standard reply Please call by after 2 Weeks and the file should be coming back from Storage .
But the File never came from Storage to NSC after waiting for 3 + Months .
Attorney contacted AILA Liason and they said that they could not do anything unless they had a physical file in NSC.
Attorney advised that since it had been 11 + Months it would be worth trying the Premium Processing Program by paying $1000.00.
I was so desperate to get this thing behind , that I was ready to shell out $1000.00 from my pocket.
Send the Cheque to Attorney and Attorney sent the Request to NSC for h-1 B Premium Processing on July 2nd.
Attorney Office Receives a Letter from NSC on July 6th stating that they are again transferring the case to VSC (Vermont) and Case was sent by FedEX including a fedEx Tracking Number to VSC .
Attorney Office sends a E-mail to Premium Processing to Check the Status and check if the INS was able to get the Case File from Storage. (July 7th)
Attorney’s Office receives a call from an efficient INS Officer in the Premium Processing at Vermont (VSC) and the Attorney explains the whole situation to the Officer and the Officer talks to her supervisor to check if VSC could process the case and finally gets the Green Signal to Process the Case in VSC .
The Officer also requests a Attorney copy of the Original H-1B File be sent by FedEx be sent to her. The Attorney Faxes the File to Vermont and after two days receives an Acknowledgement from VSC that the File was received .
The Very Next Day the Attorney ‘s Office gets a E-mail from Vermont (VSC) Premium Processing that the Case has been Approved with I-94 and the Approval Notice will be sent by Mail in One Week…… (July 11th 2002).
The Sleepless nights over the last 11 Months have ended and thank god for his bleesings all along …..
