H-1 6 Years Expiring, Extend the visa if labor approved

I came to USA in Sept 27,1997 and current H1B visa is valid until Sept 26, 2003. I haven’t apply for Labor/GC so far. My current employer will apply for Labor in next month in IOWA State (Labor is current there) through RIR case. If the Labor approved before Sept 26,2003, is there anyway to extend my H1B visa?

I heard the following news from others/Internet. Please confirm whether it is true?

1) If the labor approved, apply for I-140 and if it is pending, I can apply for the 7th year extension.

2) If the labor approved, I can file I-140/I-485/EAD concurrently and there is no need apply for 7th year extension (or I can apply for the 7th year extension)

Thanks in advance,

ASHKAR.

1) is true.
2) to be on the safe side, apply for 7th year extension after filing
I-140/I-485/EAD concurrently. Since it takes some time to get EAD.

so hurry and start your labor.

Good Luck to you :)

Thanks for the valuable information.

Hi,
Can i know how your employer is applying in Iowa. How long did they run an ad there. And how many ads. Does your company physically work from Iowa. How many days are they waiting before filing for labour?

Thanks

3 adds are enough. After 30 days of add, you can file for the labor. Yes, my employer has an office in Iowa.
