Guys with EAD only (no valid H1)!

While the detentions are un-lawful (To arrest without warrants). Your question is hypothetical. INS won't be able to handle the registration volume if they start registering non-immigrants from all countries - there would be millions ( a couple of millions atleast). Those with expired h1 and valid EAD are lawful if they have a pending I-485. Those arrested entered the US illegally or overstayed (lived in illegal status for a certain period of time). The intention being that they want to catch terrorists from certain countries, I don't think it will expand to all countries.
 
I feel INS will extend this provision to other countries. The real jail filler would be mexico, but since mexicans are not terrorists (so far), they wouldn't be a part of this until quite sometime. Illegal mexican immigrants are more or less legal. Y'know they will soon even get social security benefits. Especially in California it is amazing how two sided this policy is. Not denouncing illegal immigrants, I think they are hard working down to earth stay out of trouble people. but I just wished they'd legalize it, and then let them in, so they could pay tax, and be a part of the system.

Special registration .. Expect India to be there pretty soon though.

Regards the jails being full. yea thats a valid reason, and also members of congress are protesting this arrest and mistreatment. I don't know how much effect thats gonna have and how soon, but for now they'll continue with what they are doing.
