Guys please help..My 485 is pending since Mar 2002...pending oversees check

Hi all Guru's,

Please help me. I have filed my 485 in Mar 2002. My case still pending. 8 months ago a Person mr. HARDY called from USCIS and left a voice mail saying my case is pending because of "detailed review".

I have called him several times but, he says they can not do anything. the case is in oversees pending. And oversees has to clear the check before they can touch the file. He confirmed my name check is done.

Does any one know what is "oversees check"? How long woulkd it take.
My 485 is now pending for more than 3 years. I have once contacted the senator 4 months ago and they sent an enquiry behalf of me. But USCIS just replied back saying the case in detailed review.

Can any one please answer.
 
My case is in pending state for almost 3 years now and they keep losing my RFE . Never heard of the message you recieved though .

Do you think going to the local office via infopass would help?
 
What is your country and city of origin ? I mean which US consulate abroad is responsible for visa applications filed under the jurisdiction that you come from/got ur passport from/reside in?
 
What is oversees checks? This is something new I am hearing about. I thought detailed review was name check. So does deatiled review means oversees checks also?
 
I heard from my attorney that both my 485 and 140 are waiting for overseas info. a couple of months ago. Most likely would be a long wait. You just have to wait.

They sometimes send cases to US consulates in applicant's home country for credentials/information verification. The consulates then take their own time (sometimes they also send further inquiries to universities etc.). Don't know if they just pick some cases randomly or if they have some filter criteria for further verification. This is very frustating.
 
If they send query to universities etc. the 140 would not be cleared, I presume.

I am just trying to link why in some cases 140 is cleared although checks are pending and in some cases, both 140 and 485 go on hold. When people call emergency number, some are told 140 / 485 both are on hold ( Like CSC_PAWN was told) where as some are told checks pending for 485 but 140 still gets cleared.

Probably they have categories of checks say -

Cat 1- All checks pending e.g. 140 / 485 go on hold
Cat 2 - Personal chekcs / name check pending etc. in which case 140 is not on hold but 485 is.

There could be more categories also.

What do you think guys?

HI all,

Thnaks for the reply's. I am a citizen of India. So I am guessing the oversees check will be sent to the Indian consulate in Chennai.

Is there any one who had this experience? How long normally the consulates take to get back with the information?

Any Information would be appreciated..

Hi,

In fact i also received similar call from DHS, informing me that my case has gone for overseas investigation. name check cleared for 1.5 years. Same as your case.My I40/I485 are pending
As this is more than a month old posting, did anyone hear back from DHS or got their case approved. it could be of some hope..
 
Overseas Name Check Pending

My case is also pending the same way atleast since April this year. I'm from India & my case should be handled by Chennai consulate. BTW, have you graduated from Osmania university?

Do not worry its std procedure,

Overseas mean background-check, namecheck and bkg-check are two different things, its mean the consulate in the nearst city u lived/home country would submit some kind of detail about ur bkg.

it seems bkg mean they send request to embassy for bkg-check.

A name check with Division 4 of the FBI is initiated electronically by the
CLAIMS 3 receipt of the I-485. If no response is received within 60 days
after the C3 entry is made, the CAO may proceed with the I-485 adjudication.
Positive responses are sent to the local Law Enforcement Support Center who
will send the relating material within 48 hours of receipt or contact to the
Service Center POC holding the I-485 to ensure that adjudication of the I-485
is withheld until the third agency material is obtained and reviewed.

it seems Name check is FBI and Law inforcement records check
