09/99-08/00: Work in Company on OPT
08/00-09/00: Stayed at home with Leave Without Pay waiting for H-1B (OPT expired in 08/00, applied H-1B 05/00, but the H-1B quota were used up in June, got H-1B approval in Sept).
10/00-present: Work in Company on H-1B

In LC I put 10/99-present: work in Company. In the Biographic Form, should I fill the same?? Will INS ask how I had worked between 08/00-09/00? The INS policy at that time said I could wait for the H-1B in US if I filed the H-1B before the expiration of OPT.

Hi GKing

So u worked for 3 months after the xpiry of your EAD right. Now if you did go out of the country and got the visa stamped, then you are perfectly fine. If you didn\'t, then there is a problem. But you can file for 485 under the 245(i) law which has been recently extended.
