Guys,

Here is my plan.

Let me know if there are any holes in it.

Currently in high tech job.

EB1 OR petition approved.
AOS/EAD/AP file April.

Plan to give up current job and move into
Academia on 01/01/02.

My group is currently being spun off but I
will probably remain on the books of the old company
till Jan 02.

If GC does not come through before Dec 15, then
use 180 day rule.

If GC does come through before Dec 15, can leave
old job immeadiately, as the "intent" requirement to
stay with old company is no longer valid
as they spinning off and when I joined it was
a big 10,000+ person company not 10 guys and a
few computers. Right?

If GC comes through early, then leave and travel
the world for a month or two before starting on
Jan 01. (This is a dream, but if helpers dream
can come true ...)

Thoughts?
 
180-day rule applies to similar job

And that is the \'hole\' - previous postings in this and other discussion groups have yet never come to a conclusive end about the 180-day rule, especially with respect to EB1 petitions - if you are getting out of industry and into academia, are you sure your job in academia will be in same or similar classification - to escape possible repercussions if there is an RFE or at the time of stamping interview?

If you look at the I140 form.

The box for EB1-OR says:

"Outstanding Researcher or Outstanding Professor".

In both jobs I will be using the same skill
set that I was deemed outstanding for, so I
don\'t see it as a problem.

Now the change in salary worries me.

I\'m going from mid 100,000\'s to only about 70K.
However, I will argue:

a) Cost of living in Bay area is much higher than
   new job.
b) The academic appointment is only for 9 months.

I tried to pay an attorney to get his opinion, but
no one wants to take the task.

One possible way out is to reapply for I-140. For academic
faculty positions, the I-140 is a smooth ride and approval
is almost guaranteed. The disavantage is that you lose
precious time.

My wife would kill me!!!

She desperately wants to work.
We just got our EAD cards.

My other concern is that we
say I140 is fast, but it can always
change right. Some of my colleagues
who filed I140 in 98 says it took
over 1 year back then.
