My Sep 2000 CSC case was approved on Jan 17th as per the avm. I changed my jobs after 180 days and used AC21 to get my approval. I recd. my approval notice in the mail on the 23rd and got my passport stamped on the 25th in San Fransisco. So the wait is finally over !!
I am grateful to this board in keeping my hopes going thru this ordeal. Thanks to everyone in this group for their participation.
Here are my case details:
CSC EB2 India PD:8/98
Labor approved - 6/99, I-140 - 8/00
I-485 RD:9/00 ND:10/00 FP:02/01
In april 01 I got an RFE asking me to refile my I-140 because of company name change or hold it in abeyance pending AC21 regs. However our company had shutdown in the first week of april. So asked INS to keeping the case pending.
In May 01 I got a new full-time job almost identical to my old job and similar salary.
In july 01, the INS informed me using an RFE that my case had been held in abeyance AFTER the INS had issued the AC21 Initial Guidance
My old company lawyer refused to do anything at that point and I had to hire a new lawyer. Finally responded to the INS in Oct 01 (days before the 180 limit), with a letter from my new employer, paystubs, job desc etc. as per AC21 section 106c allowing job change. My new lawyer argued that I had met all conditions for job change and my case should be approved. Finally got approval in Jan 02.
I had moved in July - and spoke with an IIO at CSC in Dec to change my address.
Thanks to the address change, I recd. my approval notice correctly at my new address.
