Hi All,

my future labor is approved and applying for I-140, i have not moved to this company yet, this company has 15 employees with annual income of 600k and has a gross profit of 200k.my labor shows salary as 70k. what do u think my chances are. ???
does my chances improve if i move to this company and run paystubs.
does the certifying officer look at the profit(200k) salary(70K) black & white and decide the companies ability to pay or is there any other logic ???

My colleagure contract's employee is having 7 employees and all of them make about 90K each approx. So, companys gross income is about 650K and net profit is less than ONE annual salary. He got an RFE about ability to pay. And two other employees I104's got rejected. Good news is that one of the two appealed and got the case approved.

Appealed info : Even if the company net profit is Zero, as long as the company could pay the salaries, that is good enough. Company had consistently maintained those 7 employees for 2 and half years cutting paystubs regularly.

site note : a non-profit organization like a church, temple, etc still can process GC, even thought the net profit is ZERO.

Make sure you have a good lawyer to appeal, just in case
 
Same here..

My company has only 4 emplyees.
In labor we mentioned that my position as Software Engg and salary 80K.I am the first person to file the GC ,since i am the only Indian here.My company Gross Salary is 600K and Net Profit is 140K.My current Salary is 60K with all benefits.

Will there be any problem for me regarding my I 140?
I was reading somewhere on this forum that some one had the same problem where his labor salary is more than the current salary and he got his I 140 Denied.

I applied for my I 140 on 10/28/03 , and my 1 485 in Nov with I 140 Receipt.
EAD approved on 12/29/03
AP approved on 01/02/04
FP Date : 01/28/04


Any Suggestions Please ???

Hello U_take_it_easy,

since my situation is same as ur's,
I talked to my Lawyer(Sheela Murthy's Para-Legal).
She said that as long as u r company shows profit,it should be fine,doesnt matter how much the gross profit will be .
and also they will check if the company will be able to pay for u.

in u r case..i think it should be fine...talk to u r lawyer once and proceed.
