Hello friends,

Here is my status...

Case currently with local BCIS ..have not received any notice for interview yet..
Working on EAD since almost 1 1/2 years after switching from original employer through which GC was filed , after 180 days stipulation...
Current company laying off people..starting next week..
Applied for some jobs ...

Got a very good consulting position with a good rate ,long term according to the VP i spoke to in CA (1 yr long min)

I can work through a company on it's payroll for this consulting contract position ..

Gurus i need your advise here ..would there be any problems with the BCIS further if i take up this contract position which means i will be joining another company for the sake of payroll?

Or do i have to search for a full time position only?

If you join your friend's company for payrole, then you are a full time employee of that company. It soes not matter who your client is. What is the confusion here ? It's much easier to join a friends company using AC21 because he will provide what ever documentation you ask for (remember that the skillset / nature of job should be same )
 
If you get a W2 then there is no problem

If not then it becomes a "Grey Area" thing. To be safe just make sure that they pay on W2 basis and also provide you a Employment letter. Even on W2 you could get paid hourly which is not a problem.

The way you explained your situation, it looks like you will be paid on W2 if not then please explain in detail .

the problem is i have already used the AC21 rule 1 time..

would it matter if the case is transfered to the local center and i am changing the employer 1 more time?
 
I will be treated by my relative's company like a regular employee of the company ...i will be given an employment letter ,paystubs every month w-2 at the end of the year and all..

would it matter to the BCIS if i am switching jobs so often..?
 
No it does not...you can change as many times as you want

Moreover you were laid off !

Make sure you take your lawyer to your interview if you get transfered.
