Gurus,

Here is my case. I got my labor approved after 3 years (Chicago & Dallas BEC) in 1st week of October. I've been in the US for the last 8 years on H1B (+extension). My employer told me this morning that my labor is not approved but is still pending. He had not given me my approved labor certification but had asked me to provide documents for I140.

I think my employer is trying to let me go and sell my labor to another high-paying individual. I'm saying this because it happened to a collegue of mine. I talked to a lawyer who said that with the labor approval copy, another company can file for a H1B extension.

Is there any way I can get a copy of my approved labor? I greatly appreciate any help in this regard.

Thanks,
Ashok.

Talk to your company people again and again

I have got a copy of approved labour from DBEC directly. My company people didn't show me the letter. They just called me and said my labour was approved.

How do you know that your labour is approved?

Even with the approved labour copy you cannot do anything since your company only can use it to file 140. Without their help you cannot do anything. Give all the documents and experience certificate, cheques, lawyer fees(if any) to file 140. And believe them, you are doing it till now.

On October 1st week, DBEC was processing May/Jun 2003 applications only. So, I hope your priority date also will be on this timeframe. Even if your company plans to use this labour to somebody else, then cannot file for 485 since it is retrogressed.
