My 140 and 485 have been denied because of missing documents/documentation error in my 140.I was asked to appeal within 30 days with form I290b.Please help me understand the following

what are the chances of me getting approved, if I appeal.

How much time it takes from the tsc to give a decision

If you wish to appeal you need to file a motion to re-open or reconcider
Time is of the essence , as you say you only have 30days.

Normally if paperwork is missing they will send a referral notice and not deny. Please explain error on documentation? This is more likey the reason if they think you lied or not a genuine application

Did you do paperwork yourself? Eitherway seems you need a good attorney without delay if you wish to proceed with an appeal etc.,

The chance depends on what the error on my 140. What is it?

Thanks for the repliy.My attorney filed for me.Intially they sent an RFE for missing documentation, and we filed an ammendment ETA750b which has some error so they denied.I'm so tensed.Is there anyone who got approved after being denied for whatever reasons.

Although my lawyers (yes, I've got two) hardly make any mistakes in filing, they always send me copies of the forms they prepared for my perusal before actually sending to the CIS. (They also send me copies of the final forms after they send them to the CIS) This way, I can check what's on the forms and double check for any possible mistakes. I personally feel that it's important not to leave just everything to the lawyer. Apparently, your lawyer made some serious enough mistake, and you would now want to scrutinize his/her work!

Good luck. I am sure your case will be approved eventually.. Have heard of many cases that got rejected first and then approved.

I have heard of cases that have been approved after being denied but this could take 6 to 12 months pending on how much paperwork needs doing


I think you are better off getting a new attorney to review your file and get appeal in asap via certified mail
