I was laidoff from work on Aug28.
Here are my doubts about AC-21 usage.
my I-485 is pending for 8months(>180days) WAC 02-074

1) Do i need to inform my sponsoring employer's attorney about my layoff right now ? or Can I wait until an RFE is issued and inform about this ?
2) Do i need to inform INS regarding layoff and decision to use AC-21 right now ? or Can i wait untill RFE is issued ?
3)I have a job offer with similar Job responsibilities from a new employer. But my project starts after a month. So I won't be on payroll for a month... Will this create any problems when i use AC21 ?

Any other useful info will be appreciated ....

First congratulations on your new job offer !

I have used AC21 after 8 months not a layoff just changed employers.

My old company attorney is still representing me. I have even talked my new company attorney he was of the opinion not to inform INS untill an RFE is issued since they were not sure even if it goes into your file even after informing. That was also the opinion with my old company attorney.

So you are in good shape, in case of RFE just wait to reply untill you get a couple of paychecks from new employer and respond.
 
I am in a similar situation i changed my job after 200 days as my project was over and my GREAT Consultancy firm was acting weird saying that i wont be paid from the day i complete my project .Luckly by grace of GOD i got a similar job and joined it after 15 days .

My attorney is one of the top 2 attorneys for immigration,they initially said that we will just wait for the RFE and then inform INS of the job change .But after 2 weeks they changed there advice and said that we need to file for a portability before INS sends a RFE ,and i did what they said as i did not want to do anything against the atorney advice .But my colleague who was in same situation as me never filed any portability as his attorney advice him not to . I sincierly feel that my attorney had did it for the extra fee they charge :( for this portability or may be he did what he felt right for me i am :confused: .

But i feel that there is no need to inform the INS as all the attorney did was a comparative sheet with the JOB DESC,JOB TITLE,SALARY of the LC job and the new job and a letter from new employer ,which we can do for a RFE also .

But as this whole AC21 is a big ? and as each attorney advices differently better stick to what ur attorney says as he knows ur case better than us .

Can you please tell me your attoreneys name because I am looking for a good attorney becuase I might get laid off next month and my company attorney will not represent me . Thanks in advance for the info.

I had my whole process done by him ,they are real professional,i never had a problem with them .
If you are looking for a good lawyer i would advice Rajeev for that :) .

And as for changing jobs it must be OK be :cool: , you have lot of people like us to give company .Good luck (Hope you get ur approval before you spend money for filing portability .

But do check with couple of lawyers before you spend money .
