All,
my employment-based I-485 case was filed in CSC back in Dec, 2001. For the past 6 months, CSC has been stuck on 16 Nov, 2001 in its JIT report...
Meanwhile, six years on my H1 counter are also up and a 1-year extension H1 has also been filed...

Now, in a couple of months' time, I want to go on a Leave of Absence - if I do so, is this going to impact my immigration process ? Will there be any issues in my H1 and 485 processing ?

Any and all inputs will be useful....

Thanks.

It should not affect generally speaking if you are present on the payroll. There could be 2 scenarios

1) They ask for last 3 months paystub ( if they do u will need a letter stating that you are on leave without pay) and also an EVL stating that you will be employed once GC is approved.

2) No RFE or only EVL - Best scenario for you.

Bottom line If your employer is co-operative you should be ok

Of course there are other scenarios like an Interview where again the first response would apply

You don't have to care about your H1Bs if you are on EAD.
It will not impact your 485s or H1Bs as long as its a paid leave.

what do you mean by "happends" ..i did not get it :D :D
