We are planning to invite my mother to U.S and need some expert advise on some concerns.
Myself was an H4 visa holder and my Husband is an H1B visa Holder. I am employed from Feb 2005 and I got my green card thru employment on July 2005. My husband's AOS application ?(Derivative applicant) is still pending and he is still on his H1B status.
In this background, whom shall we use as the sponsor ? Me / Husband ?
For me : I dont have any W-2 till date and has already done an AOS from H4 to GC. Will USCIS think that I'll somehow do the AOS for my mother (though we dont have any plans and my mother do not want to stay in US) since I am already done that for myself ?
For my Husband : Has 4 decent W2 forms but official status is 'Pending AOS' though he is still on H1b . His status might change any time before the interview ?
Is it MUST to have W2 forms (atleast one) OR a recent 2-3 Paystubs and a letter from employer is enough ?
