Gurus!! please help me understand this

Hi,
my labor certification is from Delaware and i am working for a client of my company in California. My Companys attorney filed the I140/I485 to CSC with ND Oct 03 2003. i got the EAD in Jan and FP done in April and i confirmed with
USCIS cust service guys that filing like this to a different center is fine.

Now i got emails that my I-485 is transferred to Vermont. There is no
status update of my I-140 though. i dont know whats going on.

do you know if the filing date of I-140 and I-485 are going to be preserved
in case of transfers like this.

could somebody explain these things to me..

but i dont understand why my I-140 is not transferred. do you think it would also be transferred to VSC soon.
Also when u say that the dates are preserved, then that means my I-140 [ filing date Oct 1 2003 ] should immediately be approvable at VSC right ?

I am sorry, I meant PD will be preserved. I should have been clear.

I am not sure about I-485/140 dates and why I-140 is not transferred. Unfortunately no can predict timing & working of USCIS service center.

Your priority date (LC application date) will be preserved. When a case is transferred to a local center the date on which the case is transferred will be your new notice date. And the local center would process your case based on that.

For example if your case was transferred on Sept 01,2004... you need to wait till that district service center processing date is reached. Vermont is a good center to be transferred as the current 485 processing date is Feb 2004.

On September 22, 2004, we transferred your I485 Application to Register
Permanent Residence or to Adjust Status to an office in VERMONT SERVICE
CENTER for processing. That office has jurisdiction over the case. They
will send you a written decision as soon as processing is complete. You
should receive a notice informing you that your case has been
transferred to a local office. Please call the National Customer Service Center
at (800) 375-5283 to receive information about local office processing
times.

If you have questions or concerns about your application or the case
status results listed above, or if you have not received a decision or
advice from USCIS within the projected processing time frame*, please
contact the National Customer Service Center.

please let me know if someone has seen a case like this. and if so what happens to the original filing date ?

Check the link in my previous post. When a case is transferred to a district office, the district office processing dates will take precedence over the service center dates.

Your case is tranferred to VSC and not the St.Albans office. So you should follow the the VSC date. When a case is transferred to a different service center they would either issue a new EAC (or WAC etc) number or maintain the old number. So wait till you get a letter from VSC. Also, did u call the NCSC?

Looks like case is transferred to Vermont Service Center, not district office.

All EB cases are handled by Service center and they are only forwarded to local district office when I-140 is approved but interview is required for I-485.

I don't think that's the case here.

Also, dates you have pointed are mainly for FB I-485.

Yes thats what I said in my previous post

There are NO separate dates for FB applications? where did u get that from?
