Hello Gurus,

1) LC - MS/BS+5 Approved, If I140-EB2 denied, can 140-EB3 be filed using the same LC.

2) I have seen postings where spatel70 and others have said that in these cases, EB3 can be applied using the same LC. Has anyone done this and has been successful.

3) If LC - MS/BS+5 Approved, then in order to avoid RFE and denials, can the person directly file I140 EB3 instead of I140 EB2.

Please answer.

Sure you can apply in EB3 category. Your lawyer should know the procedure. You don\'t have to apply for another labour for EB3.
