I am relocating to Austin Tx (TSC area) for a wonderful opportunity I got. Currently am in Portland OR (NSC area). Gurus, please comment if this could pose any problems in 485 approval.

Am using AC21 for 2nd time.

RD Oct 2001 (NSC)
No RFE, FP : Jan 2002
So far 3 EADs, 4 APs (3 + 1 emergency) approved

A couple of notes:

(1) You will now fall under the jurisdiction of TSC. That may slow down your case if NSC decides to transfer your file since Texas makes these guys look efficient.

(2) I dont' know if switching companies multiple times raises a flag (i.e. intent to stay "permanently" with your employer. You've already invoked AC21 once, so maybe your attorney doesn't suggest notifying BCIS of the 2nd job change.

sadiq

p.s. I'm definitely not a guru!

I am not sure, just because of the fact that I moved to TSC area, they will transfer the case to TSC.

Many times they just transfer to local offices ..... allthough as I recollect vaguely some one got their case transferred to another service center.

Anyone please share if you know of any case of service center transfers.

sadiq stated good point.

its better not to notify 2nd job change unless there is an rfe. but any way you HAVE to admit this at the time of i1485 approval or interview.

try to stay in one company for some time. eventhough there is no restriction on how many time you can switch employer using ac21 but your putting greater risk to your greencard that you would not show any intend to work in a company permanently.

What if ..

you work for a consulting company and you are on a new client engagement in a different state. So technicaly , you would still be with your old company which falls under the NSC , but since you would have to relocate to Texas or say California and file for an AR-11 with that address , the folks at NSC will feel that you have relocated permanently and will transfer your file to that center. There is no way of letting them know that you are still with the same employer which falls under the NSC jurisdiction.

Any thoughts ....

I would again say ...

It is my understanding that mere relocation to new service center (with or without previous employer) does not necessarily result in transfer of case to new service center.

There is no tangible evidence in the forum regarding transfer from one service center to another.

Please share if you think otherwise.

reforgreen is abolutely correct. There really isn't a steadfast rules regarding transfers with Adress Changes. On the flip side, let's recall the thing predictable about BCIS is they are unpredictable. No rhyme/reason/pattern behind so many of their decisions and policy interpretations. It's a matter of risk tolerance.

sadiq
