Gurus,

My I-140 ND is Oct 21, 2002 and is still pending. Last LUD 03/12/03. No updates after that .

I got a transfer within the same company but in a different state within VSC service Center. Can I move to the new location and how will this affect my GC process? If I submit the change of address, will the USCIS deny my I-140 case because of the change is location?

Please advice!!!

It should not be a problem. You should be fine filing AR11 for address change. It's really very frustrating waiting for so long. Wish you an approval pretty soon.

Hey I was in the same siuation as you are. My 140 ND is March 2003. Did everything you did congressman andall shit load with no results.

Well however your AR11 will not result in denial of 140. I applied for my AR11 and the LUDs of my 140, 485 (mine and wife's) changed after that. Then you will receive a letter from USCIS confirming the change. After that back to square one.... wait.

But my Company lawyer says that since LC is based on geographical location, and the labour market for the new location has not been tested for my job, I cannot move to the new location unless my I-140 is approved and then I can use the AC21 provision.

Also I was told by Senator office that since my I140 and I-485 are concurrently filed, my I-140 MAY be approved only with I-485 according to the new rule. My RD for I-485 is Jan 23, 2003 and no LUD since March 13, 03. No FP2 notice.

2nd EAD and 2nd AP done.
 
Though this is not the answer to the question you are asking, I understand that as per the new rule some people might get their I-140 processed according to their I485 date, which should happen soon for you.
