My and my wife's I-485 petitions were approved on 12/15/04 and we have received approval notice. Incidently, my son's case is not approved. He is just 8 year old. USCIS website is still showing it in "received state". Any ideas, what could be going on?

My wife and son are planning to travel to India on Jan 1, 2005. Tickets are already confirmed. We have valid Advance Paroles with us. Now, since my and my wife's cases are approved. I am kind of confused, if we (me and my wife) should go for PP stamping, and then my wife uses Stamped Passport and son uses AP for his travel? Is there any complication in this scenario? Or Will my son's AP become invalid the moment I/we get our PP stamped? Will there be any issues/ questions at the time of his re-entry?

On the other hand I feel that I should get my PP stamped without loss of any time.

What should we do? Please advise.

Thanks in Advance.

As far as I think, you must get this damn thing stamped on the passport, it will void your and ur wife's AP but not sure if it will void ur son's AP too.

Now looking at the trend, My guess is that ur son is also approved and u can take him with you to usics office and let them checj the system and most probably they will get to know that he is approved and you can get him stamped, btw, as far as i know, kids below 14 yrs of age can be skipped froms tamping and there card is ordered directly.

Now about your travel plan, If you will be visitng on ADIT stamp, did you do some research about Transit Visa? I have been banginf my head of walls to find out about it.

I am suppose to fly on Dec 28th via london, london says that u do not not need a transit visa if you have a valid visa (such as h1b) stamped on your passport, you do not need a transit visa if you have green card, but they have not mentioned anything about ADIt stamp, have been calling there NYC office every day 20 times but they never take call, so I decided to go via france as some one said that you do not need a transit visa from there, but after visiting there website, looks like even they need a transit visa if u have this stamp on ur passport.
Did you do some research on this? do you think we can travel on this stamp? would really appriciate if you could share some exp on tis if you have some.

I think u will have to go to hartford office for stamping, i will also have to go there, i have appointment for dec 29th, but i want to try and do it via Walkin.

How many days did it take u to get approval letter though?

Looking forward to hear back from you.

good luck

Thanks for a quick reply.

Yes. you are right. The moment we get ADIT stamps, our APs are going to be invalid. But I am not sure about my son's. I liked your suggestion of taking him along with us and ask on-the-spot about his status.

The question, which still bothers me, if he going to loose his AP with our stamping? If not, then can he use that to exit/enter US after our PPs get stamped??

As far transit visa. One of my friend checked with British Air officials. They said on AP or ADIT stamp you need to have transit visa to go thru London. Whereas Paris is fine with AP. I am not sure about ADIT stamp. My wife and son have already used first AP to travel thru Paris without any problem.

I live in Northampton, MA. And the InfoPass system resolved my request for JFK building, Boston. We have appintments scheduled for Dec 30th. I am exploring the possibility of walk-in, as Dec 30th is too close to Jan 1, 2005 - travel date. Who knows the wheather around around here - it could be snowing.

Our approval letters arrived just today. Looks like they were mailed on 16th (LUD after approval). My attorney also received them today.

For both Chubber Singh and GKA

My experience and my research on the issues both of you brought up.

When you file for I-485 and the AP along with it, it is filed individually for each person. So your child's is different from the status of the parents. Best, take you kid and his papers while you go for stamping (and u should go asap). Chances are the he will get his approval right there.

Transit VISA:
UK:
I did some research. Flying via UK generally needs a transit visa. However if you are flying in and out of US or qualify for some of the other exceptions, you do not need one. This information is published on the official website for UK > http://www.britainusa.com , Check under VISA's and Visiting UK.

France:
The last time (07/2002) I flew via Paris, I did not need anything. I was on H1B. A lot have changed in rules since then. I have not done any research on this recently, but search this forum. There have been numerous discussions on it.

Hope this helps and remember I am not an immigration expert or attorney, use the information at your own risk.

Regards, and bon voyage.

I plan to go for a walk-in type PP stamping tomorrow or Thursday at JFK Building in Boston. As I wrote earlier my wife and kid are travelling to India on 1st Jan. My question is, will I (primary applicant) be also allowed to get PP stamping along with my wife, even though I am not travelling and have no ticket.

hay GKA,
Sure man, walkin is not specific to people travelling or something, u can do that but be prepare for long line and u might have to go very very early, try and find some one who did this, there must eb bunch of friends on this forum itself.

U cn surely do this, I would enacourage others to answer this question.

Good luck.

gka,

I was in similar situation a month ago as far as PP stamping is concerned.
Mine and wife's cases got approved but not my son's case. My wife and I went to loacl INS office for stamping. And also I just asked officer to see the status of my son's case. To my surprise, she said your son's case also got approved on the same day on your aproval date. She also told me if my son also physically present that time with photos etc.. she would have pp stamped for him also.

Later on came back home and checked the status on line and message is same as old " received your application.. it will take .. laba labla.." I called 1-800 number and told the story again to them and they told me as per our systems his case is not approved.

Later on, I took appointment again, took my son to INS office and got his PP stamped.

So, you may take your son also to the INS office and give it a try..

Good luck

Got our PPs stamped from Boston Office. It was a walk-in. As suggested above we took our son with us. They got him finger printed as well. I asked the officer to check his status and it was approved. She stamped his PP as well.
