Gurus Please advise on this I-140 case

Hello Gurus - Have you ever listened or experienced to this kind of case

On my Labour Approval min. qualification mentioned as MS Computer Science or equivalent with 2 years with Occ. Code 030.062.010 ( probably EB-2). I have the same MS Computer Science with 7+ years of experience. But unfortunately in my I-140 application it was marked as Skilled Worker or Professional Sec 203(b) (3) (A) (i) or (ii)

Please advise me on the following doubts

1. Is it possible to mentioned the above facts and send a correction to I-140 application with RD 10/12/2004 or is it proper to file correction? Employer is co-operative and ready to help if something needs to done.

2. Employer said that he will initiate inquiry in few days. if he mentions this point saying that it was mistakenly written on I-140 application as EB-3. whether TSC Support guys listen to that fact or not in the inquiry?

3. Do we need to send a correction through Attorney quoting all the facts?

2. If so, am I going to loose all the seniority and I-140 RD 10/12/2004 status and will it be treated as a fresh I-140 application?

3. Till today nothing happened from TSC on LUD on I-140 and I-485 applications with RD 10/12/2004

Kindly advise with your experience

I do not believe you can mention it was a mistake and then try to correct it.

However your employer can file another I-140 under EB2 category. Your employer can petition multiple I-140 for you at the same time. After your EB2 I-140 is approved your attorney may have to correspond with the service center to bind your I-485 along with the EB2 I-140 .

By following the EB-2 new I-140 application option, am I not going to loose earlier I-140 RD 10/12/2004 seniority?

Then what happens to the I-485 applications and EADs applied along with earlier 140. I already had EADs and APs for my members of family right now.

Another point, we don't have original copy of Labour Cetification as it was already submitted with earlier I-140 and Just have Xerox copy of LC.

So Is it possible to relate the new EB-2 I-140 application with earlier I-140 and I-485 applications at the time of applying it self now?

Please advise whether this whole exercise will complicate the issue ?
Is it better to wait and watch for EB-3 I-140 approval with RD 10/12/2004 as TSC I-140 processing date is saying 11/08/2004
