Here is my story in a nutshell. I am having a Canadian passport. In 2000 I came to U.S on a TN1 visa (company A) and family on TD visa. In March 2003 I resigned my job and got a different job (company B) and got a TN visa in April 2003 and started working in May 2003. During the conversion of TN Visas, I stayed in U.S, (did not leave U.S) and did not transfer my family's TD visa ( I did not know). But they still hold a valid TD visa from the previous employer (company A).

After 3 months, I changed my job again to Company C and got a new TN visa and that time too, I did not transfer my family's visa. I thought they were having valid visa TD visa from company A.

From Company C, myself and my family got the H1 and H1B visas and we traveled to India and re-entered U.S a couple of times. No problem.

Recently, my EB1 EA 140 got approved and we filed our I-485. Now I am getting some doubts, if the IO raises a RFE on this, what explanation, I have to provide? Hope, we won't get a RFE, but if we get please advise on how to handle this. Since, I was not aware of this that time and realized now, is there any excuse?
