One of my friend’s I140/EAD approved and 485 is pending more than six months. But his employer policy is that, they cannot provide copies of 1140 and labor certification approval. Last week he got an excellent offer and they offered to file AC21 immediately. He is in big dilemma to switch to new company without the i140/labor certification copies. What are the consequences?
Can he able to file AC21 without LCA and i140 copies?
If he cannot, how can he get LCA and i140copies???

Labor and 140 are properties of his employer. He don't need them. All he have to do are to get an employment letter from his new company and to gather paystubs with his new company. I think. so all he have to wait for is his gc approval or RFE or transfer/interview notice. That's all.

Otherwise, he can use Freedom of Information Act (FOIA). he can use the internet search engine: FOIA to find out how to get copies of all information.
 
In order to switch on AC21, he only needs the receipt notice of 485, don't worry if he can't get copies of 140 or labor, no biggie
and like USGC485 suggested, he can use FOIA to get them directly from USCIS.
However, he doesn't need them
 
Usgc485 and guju thanks for your responses.. How can he use FOIA?? Just call USCIS and ask for the copies of labor and 140 approval???
