NO. EB2 and EB3 are decided by the requirements of the position not by your qualification.

You can use an approved LC for filing an Immigrant Visa petition (I-140) even
when the person is not currently in US. Obviously you would be opting for
CP in this case, rather than 485 (AOS). The process would be the same even
if this is a Labor substitution case.
