Gurus Need Your Advice!!

I had filed for labor thru my current employer in March 03 from Texas under EB3/Non RIR but nothing has been done so far and I guess the case would have been shipped to BEC in Dallas.

I got an offer from a company in California and they are willing to process my GC starting immediately.

I have 2 years remaining on the H1-B and I guess I have to file this new labor thru PERM by default.

I want your opinion on what should be the path to be taken??

I am in a very similar situation as yours...PERM is good but it would take atleast 4 months from now to realise how effective it has been. My guess is that the first PERM approval will happen during the last week of May and we may get a lot of feedback on how good the process is. If all is well with PERM, you can convert your existing Labor to PERM in May. I dont see the point in switching jobs just for the heck of processing in PERM especially not knowing how good/bad it is. Having waited this long, my advice is to wait until May and then decide to go or no-go PERM !
 
However, I would say that if you have two years and the new company is ready to RIR then it might not be bad. However, note that if they are going to stay with EB3, you will be affected by not having a good priority date. Non-RIR on the other hand could take years to go through + I-140+ I-485. This may mean staying at current position for more than 6-7 years with no prospect of measurable promotions.

In your situation aplying for new LC under PERM will only make sense if you do it in EB2 catagory. And there is lot of confusion at this stage as who can file under EB2. Wait and watch is a good strategy at this point.

This uncertainity is really killing us all...To do or not to do????

Sometimes I think these decisions really come down to writing 2 chits and picking one up!!

I have decided to go for the California option and then jo hoga wo uparwale ke haath me hai boss.
