Gurus need: one trick question about H1/EAD

Hi All:

I am on H1 right now and I just get EAD card approved. My company does not
seem so good right now. Since it\'s a big company, they will definitely
report anything to INS. So if I change to EAD and terminate H1 now, if I
get laid off after 180 days, is there any reason my company still needs
to contact INS ? ( I assume if I am on H1 that time, then my company will
say to INS that this guy\'s H1B is terminated. So what if I am on EAD, since
it\'s Green card related, and it\'s already more than 180 days, they can not
withdraw the green card process).

Any suggestion is really appreciated.

What do u mean by

Let me clear a little bit

I think even you have an EAD, as long as you don\'t use it. You are
still on H1B.
You are right, the bottom line is to have a job. I am talking
about the worst case,say when INS needs REF for employment but
you don\'t have at that moment. By switching to EAD, it might
reduce the chances that INS requests an REF?( Since you were on
EAD when you got laid off).
