My kid I485 is applied in SEP2002. Iam planning to join in a school in INDIA. He has AP valid upto 12/12/2003.
He is going to join the school in March2003. He is 4 years old.
My question is "I should bring back my kid to US before applying AP renewal or Can i apply with out him overhere"
I don't have any time left on H1B.
Iam the primary applicant in GC process.

Second question is "If he gets GC(no hope until 2004) he should stay here like 6 months to maintain GC status or no need to stay"

Through your advices please....
 
Not sure about the first question..

I think the condition to show intention of LPR applies to every person.

Abandonment of Intention to Maintain LPR status; a GC holder has to spend at least 6 months a year in the U.S. to maintain PR status. If one just makes a once-a-year or once-every-6-months visit to the U.S., it may appear over time that the person is spending more time abroad than in the U.S. and is living and working abroad, he or she is at risk of losing LPR status. If the person plans on an extended stay outside the U.S., it is possible to apply, before leaving the U.S., for a reentry permit valid for a maximum period of 2 years. Such a permit would greatly facilitate reentry to the U.S.

My basic question is what is the best way to provide him education in INDIA by maintaining status after GC...
Iam planning to stay here for some more years..
Mean while i want to go through this GC process so that my kid will get some future benfits like " He can go to school for higher educations with out any F1 issues"

I believe DPS is opening a branch in Washington DC + other cities in USA. You can apply in that school. They have CBSE syllabus and I think they'll have boarding facility also. Check their website.
That way you can stay near your child and give him/her Indian format:) education also.
