6 years expiring Feb 12, 2002.
Laid off by company A on Feb 2001.
I 140 approval by company A on Feb 2001.
PD with Company A Sep 2000.

Working for Company B since April 2001.
I have not filed for GC through company B yet.
What are my options. If I file for GC now thru company B, can I stay beyond 6 years using my company A PD.

since you never started GC thru B, obviously you don\'t have LC/140 pending for more than 365 days, you may file it now, and wantt to take a chance with your old 140. there are different opiniopns about using old 140 for extension.

Another cahnce you can take is, file 485 using old 140, hopefully it will take more than 180 days, then use the offer letter form the new co.B

I\'m sorry, in my previous reply, I just overlooked the fact that you have already been laid off now (before filing 485). AC21 can not be helpful in this case. You have to go thru the whole GC process again. the only option to file 485 would be if co.A agrees to take you back on their payroll when the GC is approved. Looking to the layoff sitution this may not be convincing, however this might save you from the 6 yr limit as you will have EAD for the time being. The best option is to get extension on the previous 140, if it works!
 
Followup to original question.

I just found out that I have a valid H1 until Feb 24, 2003 - possibly a mistake by the INS since my 6 years run out on Feb 12, 2002. Can I continue working in the US until 2003. What are the implications ?
