Guru's Help please 7th Year extension

I filed for my labor in Jan 20th 2002 and got it approved in August 25th 2003. My H-1b 6 years is expiring in Feb 2004. I am going to file my I-140 with CP option this week. Am I elgible for 7th year extension?

I talked to lawyer he says he will apply in October 2003 for extension. Is that too late to apply. Also can I apply for H-1b extension when my I-140 is filed with CP option.
